This paper situates the problem of defeaters in a larger debate about the source of normative authority. It argues in favour of a constructivist account of defeasibility, which appeals to the justificatory role of moral principles. The argument builds upon the critique of two recent attempts to deal with defeasibility: first, a particularist account, which disposes of moral principles on the ground that reasons are holistic; and second, a proceduralist view, which addresses the problem of defeaters by distinguishing between provisional (...) and strictly universal principles. The particularist view fails to establish that moral principles have no epistemological import, but it raises important questions about their role in practical reasoning. The proceduralist view fails to distinguish between reasoning by default and reasoning by principles, but it shows that moral principles have a structural justificatory role. The constructivist view recognizes that the moral valence of normative claims vary across contexts, but denies that this is because of holism about reasons. Rather, it defends defeasibility within a constructivist account of reasoning where universality serves as the matrix of judgment. The constructivist view vindicates the justificatory role of universal moral principles, and makes room for some ordinary sources of defeasibility. (shrink)

According to Carl Schmitt, the phenomenon of the political has different forms. These forms can be distinguished based on different possible relationships between political action and the state. This article presents the history of what Schmitt refers to as the phenomenon of partisanship. Partisanship is a specific form of politics, established in the early ninetieth century, which has gradually expanded its presence. Partisan activity is characterized by totality, which has evolved to become the dominant component of political action over time, (...) particularly in the twentieth century. This totality affects not only the size and range of political activity, but it is also – and perhaps first of all – ruthless in its use of terror and violence, which is considered entirely justified by total partisans/terrorists. The paper is devoted to the analysis of the evolution of the basic political figures of Carl Schmitt’s philosophical discourse from the 1920s to the early 1940s. It emphasized the importance of the transition from a statist perspective of an ordered, territorially closed state understood as the basic area of political implementation to a dynamic formation based on the category of Volk – the Great Space, which is devoid of defining characteristics in the form of territorial borders and stable legal (...) rules. The analysis of this process is based on the analogy between the Schmittian concept of the Grossraum formation and Klaus Theweleit’s concept of fascist subject – fundamentally indefinite, broken and boundless. It is the transition from the category of the closed state to the category of Volk as a concrete and dynamic essence of the political that not only inscribes Schmitt’s thought in the broadly understood fascist discourse, but also makes Schmitt’s concept of the international political entity structurally and essentially similar to the borderless and fluid fascist subject described by Theweleit. In the proposed interpretation, the concept of the Great Space, contrary to what Schmitt claims, is not an objective description of the processes taking place in the international relations of that time, but the postulate of a new, expansive, fascist nomos of the Earth. Rozšiřuje východiska teorie s pozorností k fenomenologické kritice moderní vědy na základě prohloubení distinkce mezi galileovskou vědou a konjekturální metodou. Studie obhajuje vědeckost historie na základě širší diskuse o východiscích teorie, v konfrontaci s Popperovou kritikou její prediktivní hodnoty. Článek argumentuje, že historie jako věda je možná pouze tehdy, je-li opuštěn teoretický univerzalismus.

Vague predicates, on a paraconsistent account, admit overdetermined borderline cases. I take up a new line on the paraconsistent approach, to show that there is a close structural relationship between the breakdown of soritical progressions, and contradiction. Accordingly, a formal picture drawn from an appropriate logic shows that any cut-off point of a vague predicate is unidentifiable, in a precise sense. A paraconsistent approach predicts and explains many of the most counterintuitive aspects of vagueness, in terms of a more fundamental (...) inconsistency. (shrink)

Článek se zabývá třemi fyzikálními teoriemi, jež popírají realitu času, konkrétně koncepcí Kurta Gödela, Juliana Barboura a Carla Rovelliho. Tvrzení, že čas neexistuje, totiž přesahuje rámec fyziky a nemalou měrou spadá také do oblasti filozofie, čímž zde otevírá prostor pro jeho filozofickou reflexi. Co tedy z hlediska filozofie znamená, že čas neexistuje? Je například možné, aby změna existovala bez času? Abych mohla odpovědět na zmíněné otázky, nejprve se zaměřím na samotný pojem existence. Dále představím jednotlivé autory a jejich koncepce, (...) které se pokusím kriticky zhodnotit, a na závěr upozorním na související epistemologické a ontologické problémy. (shrink)

The need for continuing provision of beneficial experimental interventions after research is concluded remains a controversial topic in bioethics for research. Based on the principle of beneficence, justice as reciprocity, concerns about exploitation and fair benefits, participants should be able to have continuing access to benefits beyond the research period. However, there is no consensus about whether or not post-trial provision of beneficial interventions should be mandatory for participants from developing countries. This paper summarises recommendations from international and national guidelines. (...) Ethical principles and practical issues relating to post-trial provision are also discussed. In conclusion, post-trial provision is not necessary in all situations and a set of criteria are proposed to identify the situations that beneficial interventions should be provided beyond the research period. However, mandatory post-trial supply of beneficial experimental interventions should be assured for those who still need and are able to benefit from them but have no alternative access. Mandatory provision is based on universal bioethical principles such as beneficence and justice. Furthermore, difficulties associated with implementation of post-trial provision are not unmanageable. Careful advanced planning and a comprehensive partnership among relevant parties would be very helpful in solving these difficulties in practice, which therefore should not be taken as an excuse to escape post-trial responsibility. Using a multimethod approach, this article examines the link between class and masculinities by comparing the way two groups—professional men and working-class men —practice fatherhood. First, the authors show that these two groups practice different types of masculinity as they engage in different kinds of fatherhood. Physicians emphasize “public fatherhood,” which entails attendance at public events but little involvement in the daily care of their children. In contrast, EMTs are not only involved in their children's public events but also emphasize (...) “private fatherhood,” which entails involvement in their daily care. Second, the authors suggest that these differing types of involvement can be explained by the contrasting employment conditions of each group as well the gender order of their families, especially the divergent labor market positions of spouses and the division of parenting. The authors conclude by arguing that these working-class fathers are “undoing gender” while professional fathers reproduce the conventional gender order. (shrink)

Niniejszy tekst podejmuje kwestię bogów i bohaterów mitów greckich, odnosząc ją do obecnej w psychologii głębi koncepcji archetypów i nieświadomości zbiorowej. Główny cel badań sprowadza się tym samym do bacznego przyjrzenia się potencjalnej korelacji pomiędzy zewnętrznymi w rozumieniu starożytnego Greka postaciami bogów i bogiń, a wewnętrznymi przejawami nieświadomości zbiorowej, które mogą stanowić – według Carla Gustava Junga – istotę antycznych bóstw. Ponadto został poddany namysłowi problem wpływu „wewnętrznych bogów” na sposób myślenia, odczuwania i działania jednostki, wpływu zarówno pozytywnego, jak (...) i negatywnego. We suggest an approach to studying consciousness that focuses on its evolutionary origins. The proposed framework is inspired by the study of the transition from inanimate matter to life, which proved extremely useful for understanding what 'life' entails. We follow the theoretical and methodological scheme put forward by Tibor Ganti, who suggested a marker for the transition to life -- an evolved feature that is sufficient for ascribing dynamic persistence to a minimal living system and that can serve as a (...) point of departure for reconstructing it. We apply this approach to consciousness and suggest an overt behavioural trait -- unlimited associative learning -- as a candidate transition marker. We show that the enabling system of UAL instantiates the set of properties that are considered jointly sufficient for minimal consciousness, and discuss the experimental predictions and the implications of our approach for the taxonomic distribution of consciousness in the animal world. Slaughter sets the debate about what is acceptable to do to animals at an extremely low bar. Recently, there has been considerable investment in developing cell-based meat, an alternative meat production process that does not require the raising and slaughtering of animals, instead using muscle cells cultivated in a bioreactor. We discuss the animal ethics impacts of cell-based and plant-based meat on human-animal interactions from animal welfare and rights perspectives, focusing on industrial meat production scenarios. Our hypothesis is that the (...) insertion of cell-based meat in the global meat market may alleviate farm animal suffering and potentially restore resources for wild fauna. We employed a conservative estimation of the cell-based meat contribution to the global meat market in the year 2040 to analyze the consequences for human-animal relationships for both wild animals and farmed domesticated animals. We discuss possible effects of an animal cell domestication process, previously described as the second domestication, on human-animal relationships. We consider its potential to reduce the impact of human demographic changes and land use on animal life, in particular whether there would be increased biomass availability and free land for wild animals. We anticipate a major reduction in animal suffering due to the decrease in the number of individual animals involved in food production, which justifies the adoption of cell-based meat from a utilitarian perspective. For the conventional animal food production that remains, further consideration is needed to understand which systems, either high or low welfare, will be retained and the impact of the innovation on the average farm animal welfare. Additionally, it seems likely that there will be less acceptance of the necessity of animal suffering in farming systems when meat production is uncoupled from animal raising and slaughter, supported by a deontological perspective of animal ethics. Consequent to this is anticipated the mitigation of relevant barriers to animal protection and to the recognition of animals as subjects by legislation. Thus, the development of the alternative meats may be related to a significant change in our relationship with non-human animals, with greater benefits than the prima facie effects on farm animals. We define an interpretation of modal languages with polyadic operators in modal languages that use monadic operators (diamonds) only. We also define a simulation operator which associates a logic $\Lambda^{sim}$ in the diamond language with each logic Λ in the language with polyadic modal connectives. We prove that this simulation operator transfers several useful properties of modal logics, such as finite/recursive axiomatizability, frame completeness and the finite model property, canonicity and first-order definability.

© 2019 The Author. Background: The phenomenon of being 'with woman' is fundamental to midwifery as it underpins its philosophy, relationships and practices. There is an identified gap in knowledge around the 'with woman' phenomenon from the perspective of midwives providing care in a variety of contexts. As such, the aim of this study was to explore the experiences of being 'with woman' during labour and birth from the perspective of midwives' working in a model where care is provided by (...) a known midwife. Methods: A descriptive phenomenological design was employed with ten midwives working in a 'known midwife' model who described their experiences of being 'with woman' during labour and birth. The method was informed by Husserlian philosophy which seeks to explore the same phenomenon through rich descriptions by individuals revealing commonalities of the experience. Results: Five themes emerged 1) Building relationships; 2) Woman centred care; 3) Impact on the midwife; 4) Impact on the woman; and 5) Challenges in the Known Midwife model. Midwives emphasised the importance of trusting relationships while being 'with woman', confirming that this relationship extends beyond the woman - midwife relationship to include the woman's support people and family. Being 'with woman' during labour and birth in the context of the relationship facilitates woman-centred care. Being 'with woman' influences midwives, and, it is noted, the women that midwives are working with. Finally, challenges that impact being 'with woman' in the known midwife model are shared by midwives. Conclusions: Findings offer valuable insight into midwives' experiences of being 'with woman' in the context of models that provide care by a known midwife. In this model, the trusting relationship is the conduit for being 'with woman' which influences the midwife, the profession of midwifery, as well as women and their families. Descriptions of challenges to being 'with woman' provide opportunities for professional development and service review. Rich descriptions from the unique voice of midwives, provided insight into the applied practices of being 'with woman' in a known midwife model which adds important knowledge concerning a phenomenon so deeply embedded in the philosophy and practices of the profession of midwifery. In the Netherlands fertility doctors increasingly formulate protocols, which oblige patients to quit their unhealthy lifestyle before they are admitted to IVF procedures. We argue that moral arguments could justify parenting protocols that concern all future parents. In the first part we argue that want-to-be parents have moral responsibilities towards their future children to prevent them from harm by diminishing or eliminating risk factors before as well as during the pregnancy. This is because of the future children's potential to become (...) of a certain type, more specifically: a person that will be the want-to-be parents' child. Want-to-be parents intend to become pregnant and therefore have an additional moral reason to diminish the risks. Also, people who become pregnant unintentionally have the responsibility to prevent their children from harm, unless they become pregnant due to contraception failure. All people not wanting to become pregnant should use contraception methods carefully.In the second part of this paper we translate the want-to-be parents' responsibilities into practice. We distinguish four determinants of risk factors: modifiability, chance, severity and effort. We examine some evidence-based risk factors based on these variables and deduce levels of responsibility.In conclusion, formulating informal requirements for want-to-be parents is morally required and therefore also for want-to-be parents in need of medical assistance. The protocols developed by fertility doctors in the Netherlands could be seen as the precursor for a general, informal Parenting Protocol that could be developed on the basis of an extended and thoroughly debated risk-responsibility analysis. We argue that there are names with de se contents and that they are theoretically fruitful. De se names serve to challenge intuitive and otherwise plausible orthodoxies such as Stalnaker's view of communication and Bayesian views of belief update. These implications are also significant for those already sympathetic to the irreducibility of de se content.

In a recent study of undergraduates' use of information and communication technologies to support their academic work, we asked students to make video recordings of their personal study sessions. Our motivation was to capture their study practice as it occurred rather than relying solely on self-reports of their perceived or remembered practice. As we worked with the participant-created videos, we recognised their uniqueness as sources of evidence and their potential to reveal situated and authentic data. The paper deals with the problem of human freedom and the freedom of person, as seen by Russian personalist philosophers of the 20th century in their Parisian exile - N. Berdyaev and N. Lossky, both of them influenced by F. M. Dostoyevsky. Their philosophical conceptions derive from existentialism, which is the existential-experiential source of the modern personalism in general. The Russian personalists saw human freedom as one of the absolute values and included its problematic together with the paradoxes of the (...) particularity of individual being into their sear_ching for the true essence of humans. In justifying freedom as the basic human right both thinkers combine their anthropocentric approach with the Christian doctrine. The free philosophy is religious and intuitive at the same time.
